General Terms and Conditions for martiGO

 

martiGO GmbH, hereinafter referred to as "martiGO," acts solely as an intermediary between the client and the airline, hotel, car rental provider, and other partners responsible for the booking process. martiGO is not responsible for the final completion of the booking. This decision rests with the final contracting partner.

 

martiGO offers you the most affordable travel deals but does not plan them and therefore does not assume any liability for incorrect client information or the course of travel. Should any problems arise while using services such as flights or hotels, please contact the respective contracting partner, as martiGO has no direct influence over their decisions.

 

1. Availability and Offer

martiGO is an online travel search engine. Through us, availability and prices for flights, hotels, and rental cars can be checked based on the information provided by the suppliers. The offers on martiGO do not constitute a binding offer by martiGO or the provider. The customer expresses their booking request by entering the necessary data, and the provider decides whether a contract is concluded. martiGO is only an intermediary and does not guarantee the availability of an offer if the provider’s quota is exhausted.

 

The offers are merely indicative and do not guarantee availability. Even if an offer is displayed on our site, the capacity may be exhausted by the time of final booking. This is beyond the responsibility of martiGO.

 

2. Booking Confirmation and Contract Conclusion

After completing the booking, the customer will receive a confirmation email containing all the details of the travel services. If no confirmation email arrives within an hour, it is recommended to check the spam folder. If there is no email, the customer should contact martiGO by phone or email.

 

A contract is only concluded when the service provider confirms the booking. martiGO remains an intermediary and assumes no responsibility for the conclusion or acceptance of the booking by the provider. If a confirmation email contains erroneous or incomplete information, the customer is obliged to inform martiGO immediately.

 

3. Payment and Due Date

The total amount of the booking is visible throughout the booking process and is due upon the completion of the booking. martiGO's service fee is shown separately and is not refunded in the case of cancellation or rebooking. The total price is inclusive of all applicable taxes, fees, and other costs.

 

Several payment options are available to the customer, which are specified separately. martiGO reserves the right to initiate further checks in case of suspected fraud and to cancel bookings if they cannot be successfully completed. In such cases, the customer will be informed by email or phone.

 

4. Cancellations and Changes

Changes, rebookings, or additional services can be requested through martiGO, but in addition to the costs charged by the contracting partners, an additional surcharge from martiGO also applies. Cancellation and rebooking options are governed by the terms and conditions of the respective provider and can amount up to 100% of the ticket price. martiGO reserves the right to charge a processing fee.

 

It is the customer's responsibility to observe the respective cancellation conditions of the service provider. Changes to the booking can incur additional costs, which may be charged by both the provider and martiGO.

 

5. Disclaimer

martiGO is not liable for delays, cancellations, or other problems caused by the service provider. For service deficiencies by the provider, the customer must directly contact the provider. martiGO does not accept liability for the course of the travel or the accuracy of the provider's information.

 

martiGO acts only as an intermediary and assumes no liability for the actual course of the trip. Should unexpected events or changes in the travel plan occur, it is the responsibility of the customer to contact the respective service provider.

 

6. Travel Documents

It is the client's responsibility to ensure that they possess all necessary travel documents, such as passports, visas, etc., especially for international trips where specific entry requirements may apply. The validity and completeness of the travel documents must be verified by the customer before departure.

 

If a provider does not send e-tickets, the customer will be contacted by martiGO within 48 hours of booking. Should there be any problems with the delivery of travel documents, the customer is obliged to inform martiGO immediately.

 

7. Duties of the Client

The customer is responsible for verifying the accuracy of the data. Incorrect information can lead to delays or additional costs. Additionally, the customer is responsible for coordinating the individual parts of their trip, especially when booking services from multiple providers.

The delivery of travel documents is done via email. If providers do not send e-tickets, the customer will be contacted within 48 hours to discuss the next steps.

 

8. Refunds

Refunds are processed according to the cancellation policies of the respective provider. martiGO does not refund its service fee. Should a cancellation occur, the conditions of the service provider apply. martiGO always retains a processing fee, which is non-refundable.

 

Refunds are generally processed within a specific period, depending on the terms and conditions of the provider.

 

9. Legal Venue and Applicable Law

The terms and conditions and all legal relations between martiGO and the customer are governed by Austrian law. The legal venue is Vienna. This agreement applies to all users of martiGO and is binding once a booking is completed.

 

10. Changes to the Terms and Conditions

martiGO reserves the right to change these terms and conditions at any time. In such cases, users will be informed by email. The terms and conditions that were valid at the time of booking will always apply.

 

Effective: October 2024
